Mytrans Consignor Agreement

All prospective consignors (clients) of Mytrans must read the following terms carefully before registration. When you click on the "I agree" button or start to use the services (website, service, app, and related technology) on Mytrans, you would be deemed to have understood and agreed to all terms and conditions of this agreement.

A. Security and Privacy of Personal Information

  1. Mytrans must be notified immediately of any changes made to the account information by consignors after registration. Any damages to the rights and interest of Mytrans or translators caused by inaccurate information shall be fully borne by consignors.
  2. Mytrans uses industry standard efforts to safeguard the confidentiality of your personally identifiable information. Besides, Mytrans shall keep your personal information confidential and shall not release to any third party.
  3. For integrity of the transaction data, consignors are not allowed to request removing the accounts once they have any project completed on Mytrans.
  4. Under the following situations, Mytrans reserves the rights to hand over the consignor's information to relevant bodies and named third party witnesses for the infringement of rights:
  5. Consignors are responsible for safety of their personal information, account ID and passwords. They should change their password periodically to prevent unauthorised access to their accounts. Any entry into Mytrans through the use of an account ID and password shall be deemed as authorised activity by the account holder.

B. Project Consignment

  1. All transactions completed in Mytrans are translation works agreed between the consignor (client) and the consignee (translator). Mytrans only provides the following services: trading platform, project matching, project management, payment mechanism and dispute resolutions. Mytrans takes no responsibility for any client losses caused by project delays or translation qualities.
  2. Translators who offer translation services will be solely responsible for the quality and content of the translation work, as well as special request by consignors. Mytrans will not be responsible for any consequences arising from these issues. However, Mytrans will try within its means to help settle disputes and speculations between consignors and translators during and after translation projects.
  3. Once you consign projects on Mytrans, you are deemed to have agreed to all terms of this agreement and all guidelines and provisions stated by Mytrans. Any change of your information (such as email address, contact number) must be feedbacked to Mytrans immediately. Variation of information cannot be used as an excuse for the breach of any terms. Besides, Mytrans reserves the rights to accept or reject your consignment of projects.
  4. Consignors agree that the electronic records on Mytrans shall be used as references for any transaction on Mytrans. These electronic records will be used in the event of any disputes. If any information on the electronic records are found to be inaccurate, it is the responsibility of consignors to notify Mytrans immediately.
  5. Translators are not responsible for any typesetting work when engaged in the translation projects. However, the paragraph formatting of translation must be arranged in the same manner as the original.
  6. Consignors can choose to separate their translation projects into batches for large projects. Translators are deemed to have agreed to such an arrangement once they accept the project and agree to ensure quality translation within the stipulated deadline. In such an event, consignors reserve the rights to decide whether or not to proceed with the next batch.
    If consignors terminate the translation project for any of the following reasons, they reserve the right to refuse payment for the current finished batch.
    If both parties dispute the quality of translation, both parties must agree that Mytrans' verdict shall be final.
  7. Unless under any special conditions, consignors can have a 3 to 10 days inspection period (depending on the size of the source file) and the right for at most 2 correction request after the translation is delivered. Consignors are not allowed to request any correction on the translation work after the inspection period is expired.
  8. To ensure the confidentiality of consignor's project material, Mytrans will delete consignor's project material and its translation 30 days after completion of the project.
  9. The consignor is the copyright owner of the project material and its translation work. Translators agree to ensure the confidentiality of all client's material and information. Unless authorised to do so in writing, Translators must not reveal the material and information to any third party. Translators agree to be solely responsible for the compensation of damages incurred on consignors resulted from the breach of confidentiality. Mytrans will not be responsible in any way for events. Translators are required to maintain confidentiality of client's material and information even after the project has been completed (terminated or completed). Project contents that are revealed to the public by consignors or that are common knowledged are not bound by this.
  10. To protect the interests of Mytrans and translators, Mytrans reserves the rights to suspend the accounts of any consignors found to have unauthorised dealings with translators that contradicts the normal operations of Mytrans.
  11. You are strictly prohibited from contacting with translators using email, phone or any messenger program except Mytrans' message webpage prior, during and/or following the creation, progress and delivery of a project. This also applies to any project that was closed without translation results delivered by the translator. Mytrans reserves the rights to terminate the account of offenders.

C. Disclaimer Clauses

  1. Mytrans takes necessary efforts to safeguard the confidentiality of users' data and information and to keep the normal operation of the website. However, as all security measures are subject to possible circumvention and all hardware and software of the electronic devices are unlikely error-free, we cannot and do not provide any guarantees regarding the effectiveness of the security we employ and the reliability of the services we provide. In no event Mytrans will be responsible for any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of data, loss of programs, cost of service interruptions or procurement of substitute services) directly or indirectly arising out of the use or inability to use the websites and services, even if Mytrans knows or has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, the liability to you by Mytrans for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you for the Services during the term of Membership.
  2. Your use of the services of Mytrans is strictly at your own risk and you are solely responsible for your contact with any other Member/User of the website. Mytrans assume no responsibility whatsoever for harm that may come to you as a result of your contact (of any form) with any other Member/User of the website (including but not limited to emotional, verbal and physical abuse or assault).
  3. Mytrans website may contain links to other websites. The information provided on these links are from the source websites. Mytrans do not guarantee the accuracy, authenticity and relevance of any information provided by these sites.

D. Amendment of Terms

  1. Besides agreeing to these terms, consignors also agree to comply with other provisions and regulations Mytrans has established for transactions on the website.
  2. Mytrans reserves the right to amend any terms of this agreement at anytime. Any amendments will be published on Mytrans website. Consignors can choose to accept the amendments or withdraw their memberships with Mytrans. Your continued use of Mytrans website or service in light of changes to this statement or to the relevant principles will signify your acceptance of the changes.

E. Governing Laws and Jurisdiction

  1. This Agreement shall be governed by and construed in accordance with the laws of the Republic of China (Taiwan), without regard to its rules of conflict of laws.
